Cloisters act in Uber case
Jason Galbraith-Marten QC and Sheryn Omeri, barristers at Cloisters, are representing Uber drivers who have brought claims against Uber BV (Dutch parent company), Uber London Limited and Uber Britannia Limited as test cases. They are instructed by Bates Wells Braithwaite.
The drivers are claiming that they are entitled to minimum wage, holiday pay and whistleblowing protection on the basis that they fall within the legal definition of a ‘worker’ rather than being independent contractors. The drivers won their cases in the Employment Tribunal but Uber has lodged an appeal to the Employment Appeal Tribunal which will be heard on 27 and 28 September 2017. There may be further appeals, including, ultimately, to the Supreme Court.
